Terms of Service for Slumbr

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Slumbr mobile application (the "Service") operated by us ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Description of Service

Slumbr is a mobile application that helps users track and understand their sleep patterns. The Service uses data from Apple's HealthKit and provides analysis, visualizations, and educational content to promote better sleep habits. The Service may offer both free and paid subscription-based features ("Subscriptions").

2. IMPORTANT: Not Medical Advice

The Service, including all data, analysis, scores, and recommendations provided, is for informational and educational purposes only.

Slumbr is not a medical device and does not provide medical advice, diagnosis, or treatment. The information provided by the Service should not be considered a substitute for consultation with a qualified healthcare professional. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or interpreted from this Service.

3. Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your Apple App Store account settings.

All payments are handled through the Apple App Store. We do not process payments directly and do not have access to your payment information.

4. User Conduct

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service.
  • Copy, modify, or create derivative works of the Service or any content therein (other than your own data).

5. Third-Party Content and Services

The Service may include content from third-party sources, specifically embedded videos from YouTube. We do not control, endorse, or assume any responsibility for any such third-party content. Your interaction with this content is governed by the terms and privacy policies of the third party providing it (i.e., Google/YouTube).

6. Intellectual Property

The Service and its original content (excluding data from HealthKit and third-party content), features, and functionality are and will remain the exclusive property of Slumbr and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the results of using the Service will meet your requirements.

8. Limitation of Liability

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

It is your responsibility to check this page periodically for changes. Non-material changes may be made at any moment without prior notice.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
